He <br />discussed the acceleration lanes. He stated there is no road to access 221 st Avenue. <br /> <br />Steve Fischer, 11049 235th Avenue-Stated concerns with safety at the intersection. He <br />stated trucks stack up at the intersection. He stated the road improvements should be <br />completed prior to giving the applicant the conditional use permit. <br /> <br />Todd Erickson (Elk River Police Officer speaking as a resident)-Stated concerns with <br />safety at the intersection. He stated the current deceleration lanes were designed for when <br />TH 169 used to be 55 mph. <br /> <br />Bill David, Bauerly Bros. representative-Stated that the median at 221 st Avenue is not large <br />enough for certain sized trucks. <br /> <br />Mayor Klinzing closed the public hearing. <br /> <br />Councilmember Farber stated safety concerns with this intersection. <br /> <br />Councilmember Motin stated Section 3 (01) should state, ".. .25% of asphalt product is <br />derived from the gravel operation conducted on site not later than December 31, 2021." He <br />further stated the following language should be added to Section (10) c., ".. .prior to the <br />operation of the hot mix asphalt plant." <br /> <br />Councilmember Gumphrey suggested a condition be added to the conditional use permit <br />requiring water trucks to maintain 225th Avenue. <br /> <br />Mayor Klinzing added a Section (10) d. stating, "As deemed necessary by the City of Elk <br />River and required improvements to 225th Avenue from the intersection ofTH 169 to the <br />entrance of the gravel pit area must be constructed prior to commencement of operation of <br />the hot mix asphalt plant." <br /> <br />MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY <br />COUNCILMEMBER DIETZ TO APPROVE CONDITIONAL USE PERMIT CU <br />06-20 WITH THE CHANGES NOTED ABOVE. Motion carried 4-1. Councilmember <br />Farber opposed. <br /> <br />6.2. Request by Scott Powell for Administrative Subdivision. Public Hearing-Case No. AS 06-01 <br /> <br />Mr. Barnhart stated the applicant is requesting an administrative subdivision to re-subdivide <br />two lots into four lots. He stated staff recommends Yale Street be extended through to <br />connect it between 170th and 171 st Street in order to allow traffic access to a signalized <br />intersection at TH 10. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />Kathy Raivala, 17201 Yale Street-Stated she represents the townhome association and they <br />are opposed to Yale Street being connected due the test driving of cars from the nearby <br />dealership and safety concerns with a nearby daycare. <br />
