<br />Rezoning, Custom Motors <br />May 16, 1994 <br /> <br />Page 3 <br /> <br />e <br /> <br />In short, if the rezoning is approved and Custom Motors begins looking for <br />another site, the City has several financing programs available to provide <br />some assistance to Custom Motors. <br /> <br />AMORTIZATION PERIOD <br /> <br />If the City Council approves the requested rezoning, a five (5) year <br />amortization period will begin for Custom Motors. According to Section <br />900.34 (5) of the City Code, nonconforming junkyards have five years to <br />operate before having to discontinue use of the property. During that five <br />year period, Custom Motors can work with the City exploring other sites in <br />the community. On the other hand, if after the five year period, Custom <br />Motors is still in operation, the City will be in a position of having to take <br />legal action to enforce the amortization period. <br /> <br />PLANNING COMMISSION RECOMMENDATION <br /> <br />e <br /> <br />The Planning Commission agonized with the financial and human factor <br />involved with this rezoning, however, indicated their role is to review this <br />request as a pure land use decision. With that, the Planning Commission <br />recommended approval of the rezoning, and recommended the City Council <br />along with the cooperation of the affected property owners, give consideration <br />to financial assistance for Custom Motors. <br /> <br />STAFF RECOMMENDATION <br /> <br />Staff recommends the City Council approve the rezonmg based on the <br />findings set forth in the attached ordinance. <br /> <br />e <br /> <br />rezon-cm.council <br />
