<br />_ <br /> <br />_I <br /> <br />_ <br /> <br />FROM LRRKIN HOFFMRN DRLY LINDGREN 612-8963265 <br /> <br />04.20.1994 12:46 <br /> <br />P. 2 <br /> <br />Subdivision is that Developer enter into a Developers Agreement <br /> <br />(this Agreement) with the City prior to the release of the final <br /> <br />plat for recording; and <br /> <br />WHEREAS, the purposes of this Developers Agreement are to <br /> <br />provide for the construction of all on-site and off-site public <br /> <br />improvements necessary for development of the Subdivision as <br /> <br />proposed by Developer, to provide for payment by Developer of the <br /> <br />costs for all on-~ite public improvements and Developer's share of <br /> <br />the costs for off-site public improvements, and to provide for the <br /> <br />transfer of certain land interests and payments to the City, so as <br /> <br />to fully comply with the Subdivision Ordinance; <br /> <br />NOW, THEREFORE, in consideration of the premises and the <br /> <br />mutual promises and conditions hereinafter contained, it is hereby <br /> <br />agreed as follows: <br /> <br />1.) Warranty of Developer - Developer hereby warrants and <br />represents to City, as inducement to City's entering into this <br />Agreement, that Developer is the fee owner of all of the <br />properties located within the Subdivision. . <br /> <br />2.) I~rovements - In accordance with the feasibility study <br />prepared by the City Engineer dated February 1, 1994, the <br />application materials submitted by Developer, the preliminary and <br />final plats of the Subdivision, the City Council resolutions <br />attached as Exhibi'ts B, C, and D hereto, and the applicable <br />standards and ordinances of the City, the following described <br />improvements (the Improvements) shall be constructed and installed <br />on the te~s and conditions hereinafter contained: <br /> <br />(01) Site grading to elevations shown in the approved grading <br />and drainage plan (Site Grading); <br /> <br />(02) Street grading, graveling and surfacing, including <br />curbs, gutters, driveway approaches, first sealcoating, <br />constructing and sodding of berms, swales and boulevards, and <br />planting trees on boulevards (Street Improvements); <br /> <br />(03) Sto~ sewers, including all necessary catch basins, <br />ditches, inlets, retention areas and other appurtenances <br />(Storm Sewer Improvements); <br /> <br />2. <br />
