Off-Site Stor.m Sewer <br />Improvements necessary for development of the Subdivision <br />shall be installed and assessed as follows: <br /> <br />(a) Outlet from Pond . City shall construct and <br />install an outlet pipe from the drainage pond on <br />the southern edge of the Subdivision south to <br />existing storm sewer facilities in School <br />Street. Developer shall convey to City, prior <br />to the commencement of construction on City <br />Installed Improvements, and at no cost to City, <br />a permanent easement for the installation and <br />maintenance of this Storm Sewer pipe. The said <br />easement shall be in recordable for.m acceptable <br />to City and shall cover such area and contain <br />such terms as City shall prescribe. The entire <br />cost of constructing and installing this Storm <br />Sewer Improvement, inCluding any engineering, <br />legal and administrative costs incurred by City, <br />shall be assessed to the Subdivision. <br /> <br />-' <br /> <br />(b) Trunk Facilities . Development of the <br />Subdivision will require the improvement of <br />existing trunk storm sewer facilities. <br />Developer agrees that the Subdivision shall be <br />assessed for Trunk Stor.m Sewer Improvements at <br />the rate of $600 per gross acre, for a total <br />amount of Thirty-two Thousand Three Hundred <br />Fifty-eight Dollars ($32,358.00). <br /> <br />_ <br /> <br />8.) Levy of Special Assessments. <br /> <br />(01) Special Assessments. The Developer's share of the <br />cost of City Installed Improvements, as set forth and <br />agreed to in paragraphs 6 and 7 of this Agreement, and all <br />engineering, legal and administrative costs incurred by the <br />City in the installation of the Improvements, shall be paid <br />by Developer to City as special assessments (the Special <br />Assessments) levied against the benefitted properties in <br />the Subdivision as provided herein. Reference herein to <br />Special Assessments shall include all interest due thereon. <br />All installments of such assessments shall be paid as <br />assessments to the Treasurer of Sherburne County as and <br />when the general property taxes become due upon said <br />property. <br /> <br />(02) Payment of Special Assessments - The Special <br />Assessments shall be paid as follows: <br /> <br />(a) Block 2, Lot 7: The Special Assessments levied <br />against this lot in the amount of Six Hundred <br />Ten Thousand Eight Hundred Forty-one Dollars <br />($610,841.00) shall be paid in full prior to <br />release of the plat for recording. <br /> <br />9. <br />
