ACH, CITY PLANNER .A~ <br /> <br />DATE: APRIL 21, 1994 <br /> <br />SUBJECT: RESOLUTION APPROVING FINAL PLAT <br />FOR ELK PARK CENTER <br /> <br />ISSUE <br /> <br />To consider approval of Resolution 94-_, granting final plat approval for Elk River <br />Center. <br /> <br />OVERVIEW <br /> <br />e <br /> <br />The final plat as submitted has been modified to comply with the conditions for <br />preliminary plat approval. The one exception to this relates to Outlot B along Highway <br />169 and 191 st Lane. Outlot B is the location of the proposed development sign <br />identifying Elk Park Center. Originally, it was requested this outlot be made part of Lot <br />1, Block 4, to forego the possibility of the outlot going tax forfeit and having no <br />responsible owner to maintain the property. However, this situation is slightly different <br />whereby Elk Park Center's sign will be in the outlot along with landscaping and serve a <br />necessary function for the Center. Therefore, the outlot will have a value and need to be <br />retained by its owner (Kraus-Anderson) and not left for the concerns mentioned above. <br />Staff believes the perpetual maintenance and responsibility can be further addressed as <br />part ofthe developer's agreement for Elk Park Center. <br /> <br />As a condition for plat approval the easements for extending Freeport Avenue from <br />School Street to the southern limits of Elk Park Centers project will need to be granted to <br />the City of Elk River. Ideally, this portion of Freeport should have been included in the <br />plat as dedicated right of way. However, the easement documents as approved by the <br />City Attorney will provide for construction of Freeport Avenue along with all the <br />necessary utility extensions. When the commercial property between Freeport Avenue <br />and Highway 169 is platted in the future, Freeport will at that time be included as <br />dedicated right of way and made part of the plat. <br /> <br />e <br /> <br />Lastly, as presented at Monday night's City Council meeting, the two exceptions as <br />identified on the plat will be platted as Elk Park Center 2nd Addition. This plat will <br />address the need for an administrative subdivision of Mr. Dickenson's property and <br /> <br />ELKPRKCTR-Planning <br />P.O.
