<br /> <br />City of Elk River <br />REQUEST FOR COUNCIL ACTION <br />Agenda Section Meeting Date <br />En · eerin Au st 21, 2006 <br />Item Description <br />Agreement for Improvements to County Road 33 <br /> <br />Item Number <br />5.10. <br />Prepared by <br />Te Maurer, Ci <br />Reviewed by <br />Bill Maertz, Parks & Recreation <br />Director <br /> <br /> <br />Introduction <br /> <br />The City of Elk River requested Sherburne to include a trail crossing under CSAH 33 in their <br />reconstruction project. Because of this request, Sherburne County is asking for the City to <br />approve an Agreement for Improvement to County Road 33. <br /> <br />Discussion <br />Sherburne County opened bids for the County Highway 33 upgrade on Tuesday, August 1, 2006. <br />The low bidder was Bauerly Brothers, Inc. in the amount of $2,421,000. The City requested a <br />trail crossing for the Railroad Trail underneath County Highway 33 be included in the project. <br />The agreement requires the City to pay for this portion of the project in the amount of $131,000. <br />The original estimate provided by Bill Maertz, Parks & Recreation Director was $190,000. The <br />low bid for this work submitted by Bauerly Brothers, Inc. is approximately 300/0 below the <br />original estimate. It should be noted that these costs are for construction only. The agreement <br />does not require the City to pay any overhead costs associated with these improvements. <br /> <br />According to the agreement, the City is obligated to pay 950/0 of the construction cost based on <br />the low bid, once a bill is submitted from the County. After completion the City will be billed for <br />the actual cost of the construction minus previous payments. This is similar to the Municipal <br />State Aid Funding protocol. The agreement also indicates that the City will provide construction <br />oversight for the installation of the trail crossing. <br /> <br />According to the agreement, the County will be responsible for maintaining the roadway and the <br />City will be responsible for all maintenance of the trail crossing. <br /> <br />The draft agreement has been previously reviewed by City Attorney Chris Johnson for legal <br />format. Mr. Johnson had no objections to the standard format of this agreement. <br /> <br />Finally, it should be noted that there is still an outstanding issue regarding payment for right-of- <br />way along County Highway 33. As you are aware, the County's Cost Participation Policy requires <br />the City to pay for additional right-of-way. The City was unaware that this project was even <br />contemplated by the County. Therefore, the County moved fOlWard with the project and <br />acquired the necessary right-af-way. The County expended approximately $179,000 in a strip- <br />taking along the existing County Highway 33.
