MOTION CARRIED 5-0. <br /> <br />Mayor Klinzing stated the denial is based on the zoning being inconsistent with the <br />development of the surrounding area. <br /> <br />Mr. Beck stated the denial could also be based upon their being no change in circumstances. <br /> <br />6.4. Request by Nature's Dry Cleaning for Conditional Use Permit for Dry Cleaning Operation, <br />Public Hearing-Case No. CU 06-17 <br /> <br />Planning Manager Jeremy Barnhart stated the applicant is requesting a conditional use <br />permit to construct a dry cleaning operation. He provided an overview of the project and <br />discussed parking, landscaping, drainage, and the Planning Commission's recommendation. <br />Mr. Barnhart stated the applicant will be doing the dry cleaning on site using a European dry <br />cleaning concept that is supposed to be more environmentally friendly. <br /> <br />Mayor Klinzing opened the public hearing. There being no one to speak to this issue, Mayor <br />Klinzing closed the public hearing. <br /> <br />MOVED BY COUNCILMEMBER GUMPHREY AND SECONDED BY <br />COUNCILMEMBER DIETZ TO APPROVE CONDITIONAL USE PERMIT CU <br />06-17 WITH THE FOLLOWING CONDITIONS: <br /> <br />1. NO NOISE, ODORS, OR VIBRATIONS SHALL BE EVIDENT <br />OUTSIDE THE PROPERTY LINE. <br /> <br />2. THE BUILDING SHALL MEET ALL APPLICABLE BUILDING AND <br />FIRE CODES. <br /> <br />3. WASTES SHALL BE DISPOSED OF IN AN ENVIRONMENTALLY <br />RESPONSIBLE MANNER, AND APPLICABLE WITH LOCAL, STATE, <br />AND FEDERAL REGULATIONS. <br /> <br />4. NO OUTSIDE STORAGE. <br /> <br />5. REMOVAL OF CHEMICAL/FILTERS BE HANDLED BY <br />PROFESSIONAL CONTRACTOR. <br /> <br />MOTION CARRIED 5-0. <br /> <br />6.5. <br /> <br />Ordinance to Approve Amendment to Land Use Regulations Section 30-796 Regarding <br />Pool Fences Requested by the City of Elk River. Public Hearing- Case No. OA 06-05 <br /> <br />Planner Chris Leeseberg reviewed language changes for the Council to consider to an <br />ordinance regarding when or if fences should be required for above ground pools. He <br />outlined three possible options staff considered and the pros and cons of each. He noted <br />that staff recommended Option C which states a misdemeanor could be issued if there is <br />not controlled access to the pool and requires no fencing. Mr. Leeseberg stated staff tried to <br />create a balance between accidental falls and safety but noted that if someone really wants to <br />get into a pool they can usually gain access. Mr. Leeseberg stated it was difficult to balance <br />the costs of installing a fence around pools that are temporary and there was concern about <br />
