<br />e <br /> <br />e <br /> <br />e <br /> <br />RESOLUTION 94 - <br /> <br />A RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION ACCEPTING BID AND AUTHORIZING <br />EXECUTION OF CONTRACT IN THE MATTER OF THE <br />DEERFIELD 3RD STORM DRAINAGE IMPROVEMENT OF 1994 <br /> <br />WHEREAS pursuant to Resolution 93-60, competitive bids were solicited and received for the <br />Deerfield 3rd Storm Drainage improvement as set forth in the bid tabulation <br />attached hereto and incorporated herein by this reference; and <br /> <br />WHEREAS the City Council has considered the amount of the bids and the responsibility of the <br />bidders and determined that W. B. Miller, Inc., is the lowest responsible bidder; <br />and <br /> <br />WHEREAS the City Council has considered Change Order No. 1 to extend the storm sewer <br />pipe in accordance with the Hartman easement agreement; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, <br />Minnesota: <br /> <br />1. The Mayor and City Administrator are authorized and directed to execute, on behalf of the <br />City, such contract and Change Order No.1 with W. B. Miller, Inc., as is approved by <br />the City Attorney for the completion of the Deerfield 3rd Storm Drainage improvement <br />according to the approved plans and specifications designated in Resolution 93-60. <br /> <br />2. The City Administrator is authorized and directed to forthwith return to all bidders the <br />deposits made with their bids upon execution of the contract above specified. <br /> <br />Passed and adopted this 21st day of March, 1994. <br /> <br />Henry A.
