<br />Hals Addition, PP <br />February 28, 1994 <br /> <br />Page 2 <br /> <br />e <br /> <br />ANALYSIS <br /> <br />The proposed plat involves 2.3 acres of property currently owned by <br />Burlington Northern Railroad. The plat will consist of one lot and three <br />outlots. One of the purposes of the subdivision is to replat right-of-way along <br />Railroad Drive. The existing right-of-way currently bisects the Sunderman <br />paint store and River Valley Lumber's office buildings. By redefining and <br />shifting Railroad Drive's right-of-way to the south, it will remove any <br />encroachment by the existing buildings. A newly defined right-of-way will <br />consist of an approximately 42 foot right-of-way area which will encompass <br />all driving and utility services. It is anticipated that an easement vacation to <br />vacate the existing right-of-way which bisects the buildings will be <br />forthcoming if the plat is approved. The platting process will also allow for <br />individual ownership of the lot and outlots. Currently the parcels are leased <br />from Burlington Northern Railroad. <br /> <br />Lot 1 - Lot 1 is currently occupied by Martie's Feed Store. By platting this lot <br />the site will basically look unchanged, however, it will allow Mr. Martie the <br />ability to own the site. <br /> <br />e <br /> <br />Outlot A - Outlot A is currently used as an outdoor storage area for River <br />Valley Lumber. The outlot has a chain link fence around a large portion of <br />the perimeter. Again, the outlot would be owned by River Valley Lumber. If <br />approved, staff recommends the shed which straddles the outlot and railroad <br />right-of-way either be removed or placed totally within the outlot. The <br />outdoor storage area should also be screened from view from Highway 10. <br />This could be accomplished by placing durable plastic strips through the <br />chain link fence. <br /> <br />Outlot Band C - Outlot Band C are currently leased by the City of Elk River <br />as public parking lots. If the plat is approved, the City of Elk River will own <br />these outlots and continue to use them as public parking lots. <br /> <br />PARK DEDICATION <br /> <br />The location of Lot 1, Block 1, (Martie's Feed Mill) and outlot A is zoned I-I. <br />The subdivision ordinance does not require Park Dedication on industrial <br />property. Therefore, no Park Dedication is being proposed for these parcels. <br />Outlot B & C are zoned Highway Commercial, and although park dedication <br />is required on commercial property, the City will retain ownership of these <br />outlots. Therefore, staff is recommending no park dedication be required. <br /> <br />e <br />
