This study was authorized at the request of Mr. Ken <br />Beaudry, who is currently building a convenience store/gas station at the comer ofTH 10 and <br />Proctor Avenue. <br /> <br />This feasibility study analyzes the possible construction of a right turn lane from TH 10 onto <br />Oxford Avenue. The location of this improvement is shown by Exhibit 1. Included in this <br />study is a discussion of the existing conditions, proposed improvements, and estimated project <br />costs. The project cost includes estimated construction costs plus overhead costs including City <br />administration, engineering, fiscal, and legal expenses. The City's Assessment Manual will be <br />referenced as a guide to methods of financing the project. <br /> <br />Existing Conditions <br /> <br />In March 1991, a conditional use permit was initiated by Mr. Ken Beaudry for the construction <br />of a convenience store/gas station. Following review by City staff, this conditional use permit <br />was subsequently approved. In July 1993, an extension with several conditions was granted for <br />the conditional use permit. One of these conditions was that a right turn lane be petitioned for <br />by Mr. Beaudry and that he waive any objections for assessments. A copy of the petition is <br />included as Exhibit 2. <br /> <br />Any improvements on TH 10 to construct a turn lane are under the jurisdiction of the <br />Minnesota Department of Transportation (MnDOT). The proper MnDOT authorities have been <br />contacted to determine the requirements for construction of a right turn lane. <br /> <br />202-1004.dec <br />
