<br />FEE 01 '94 1121:47 P.l/4 <br />MODEL ORDINANCE FOR ADOPTING THE MINNESOTA UNIFORM FIRE CODE <br />by: Kevin McGinty, Chair-MSFCA Code Committee <br />Jon Nisja, MN State Fue Marshal Division <br /> <br />In August of 1993. the State Fire Marshal Division adopted an updated edition of the Minnesota Uniform Fire <br />. Code (MUFC). The statutory authority for adopting the fire code, Minnesota Statutes, section 299F.Oll, subdivision <br />4, makes the fue code applicable statewide so there is no requirement for local adoption. Many local officials, <br />however, desire to adopt the flre code as a local ordinance so that they can make amendments to address local <br />fire safety concerns or streamline enforcement. The MUFC prescribes the minimum fire safety requirements; local <br />municipalities are allowed to adopt ordinances or regulations which are more restrictive than the state fire code <br />as long as they meet the following criteria (see Minnesota Statutes. section 299F.Oll, subd. 4): <br />1. The ordinance or regulation must be directly related to flre or life safety. <br />2. The ordinance or regulation must be unifonn for each class of building or hazard covered, <br />3. The ordinance or regulation cannot exceed the applicable requirements of the state building code. <br /> <br />Often times, local officials desire to have the authority to enforce local regulations such as the issuance of citations. <br />appoint local boards of appeal, control fire hazards, authorize open burning, or issue pennits. Where these local <br />regulations exceed the authority of the state fue code, it is often desireable to adopt a local ordinance in <br />conjunction with the fire code to give the legal authority to do this. <br /> <br />We have been working with the League of Minnesota Cities (LMC) on this issue. They have a model adopting <br />ordinance for the Uniform Fire Code. The following is a model ordinance which has been developed by LMC and <br />recently updated to reflect changes since it was originally written in 1976. If you are choosing to adopt the fire <br />code locally, you may pass this information on to your municipality's administration and/or governing body. As <br />with the adoption of any ordinance, we strongly recorrunend that you consult legal counsel for their review and <br />gumanre.
