<br />NOTICE OF ASSESS.MENT HEARlNG <br />(Published) <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />CITY OF ELK RIVER <br /> <br />,19_ <br /> <br />To Whom It May Concern: <br /> <br />Notice is hereby given that the Elk River City Council will meet at <br />in the City of Elk River on the day of , 19_, at <br />o'clock _.m. to consider the proposed assessment for the <br />improvement (the Improvement) and the adoption of a final assessment roll itemizing that portion <br />of the cost of the Improvement to be assessed against each property within the area proposed to <br />be assessed. <br /> <br />It is proposed that the cost of the Improvement be assessed against the following property: <br /> <br />The total amount proposed to be assessed against the benefited properties is . <br />$ . The proposed assessment roll is on file for public inspection at the <br />City Administrator's office. Written or oral objections will be considered at the meeting. No <br />appeal may be taken as to the amount of an assessment unless a signed, written objection is filed <br />with the Clerk prior to the hearing or presented to the presiding officer at the hearing. <br /> <br />Minnesota law authorizes a statutory city, in making a special assessment, to exercise its <br />discretion to defer the payment of that assessment for any homestead property owned by a <br />person 65 years of age or older or retired by virtue of a permanent and total disability for whom <br />it would be a hardship to make the payments. Any statutory city electing to defer special <br />assessments shall adopt an ordinance or resolution establishing standards and guidelines for <br />determining the existence of a hardship and for deter- mining the existence of a disability, but <br />may determine hardship on the basis of exceptional and unusual circumstances not covered by <br />the standards and guidelines where the determination is made in a nondiscriminatory manner and <br />does not give the applicant an unreasonable preference or advantage over other applicant <br /> <br />The homeowner shall make application for deferred payment of special assessments on forms <br />prescribed by the County Auditor of the county in which the homestead is located. Where the <br />deferred assessment is granted, the Auditor shall record a notice thereof with the County <br />Recorder of said county which shall set forth the amount of the assessment. The taxing <br />authority may determine by ordinance or resolution the amount of interest, if any, on the <br />deferred assessment and this rate shall be recorded by the Auditor along with and in the same <br />manner as the amount of the assessment. <br /> <br />. <br /> <br />A-17 <br />
