<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION 93 - <br /> <br />A RESOLUTION OF THE CITY OF ELK RIVER <br /> <br />A RESOLUTION REQUESTING MnDOT TO <br />CONSTRUCT STORM SEWER FACILITIES <br />UNDER THE T.H. 10/101/169 INTERCHANGE <br />IN CONJUNCTION WITH MnDOT PROJECT S.P. 7101 <br /> <br />WHEREAS, the Minnesota Department of Transportation (MnDOT) has proposed the <br />construction of T.H. 101 (S.P. 7101) which involves the reconstruction of the <br />interchange of the T.H. 10/101/169; and <br /> <br />WHEREAS, the City of Elk River Comprehensive Drainage Plan proposes a larger diameter <br />storm sewer pipe thru this interchange; and <br /> <br />WHEREAS, in conjunction with S.P. 7101, it has been determined that these additional storm <br />sewer facilities be constructed with the project; and <br /> <br />WHEREAS, the City and MnDOT agree that the construction of the total project can most <br />efficiently be accomplished by joint efforts of the parties. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, <br />Minnesota: <br /> <br />1. The City of Elk River indicates its willingness to enter into agreement with MnDOT to <br />share in the cost of the construction of said project in such amounts determined by the <br />parties according to the latest addition of MnDOT's "Procedure Cooperative Construction <br />Projects with Municipalities". <br /> <br />2. The agreement shall cover the storm sewer cost added to the project by the City of Elk <br />River. <br /> <br />3. The City of Elk River requests MnDOT to construct in conjunction with MnDOT project <br />S.P. 7101 the City of Elk River Storm Drainage Improvement. <br /> <br />Passed and adopted this 15th day of November, 1993. <br /> <br />John Dietz, Vice Mayor <br /> <br />ATIEST: <br /> <br />Sandra A.
