<br />. <br /> <br />2. The second criteria requires consistency with the comprehensive <br />plan. This was fully assured when the property ~as rezoned- and the property <br />designated highway commercial. There can be no question that this criteria is met. <br /> <br />3. The third criteria is met through infrastructure improvements, <br />road improvements and providing high quality commercial development for <br />serving existing and future development within the City of Elk River and beyond. <br />Completion of the project will, in fact, enhance and promote orderly development <br />and improvements of the surrounding vacant properties. This is a win win <br />situation. <br /> <br />4. The fourth criteria is met in that all essential infrastructure and <br />road improvements necessary for the project will be determined by the City's <br />feasibility study implemented for the project and paid for by the developer. In <br />addition, the careful design of the on-site ponds for the project will enhance the <br />quality of storm water leaving the site and thus improve the environment. The <br />project will improve traffic conditions by providing improvements which would <br />soon be necessary in any event to serve traffic projected to be generated by other <br />developments in the City of Elk River. <br /> <br />e <br /> <br />5. Criteria 5 is met in that the shopping center has been planned as <br />a self-contained commercial development without noxious uses but rather.with <br />only high quality retail serving the essential needs of the community by providing <br />food, clothing and merchandise meeting the basic needs of the people of Elk River. <br />High quality commercial development is a very clean use. <br /> <br />6. Criteria 6 is met in that there are no natural, scenic or historic <br />features of major importance on the site. The existing uses are, in fact, greatly in <br />need of quality redevelopment which this development will provide. The <br />improvement of the ponds will enhance the natural amenities on the property. In <br />addition, as noted in the City staff report, the Minnesota Historical Society has <br />indicated that there are no historical or archeological features on this property <br />which need preserving. <br /> <br />7. Criteria 7 is met in that the development has been designed to <br />meet or exceed all standards of the City. The condition of the permit to provide for <br />individual detailed site review and a Planned Unit Development Agreement will <br />assure that the high quality designed into the project will continue throughout the <br />development and operation of the center. In addition, by acting as lead developer <br />on the project and by signing the Planned Unit Development Agreement, Kraus- <br />Anderson will assure the City that all approvals of the City and conditions of the <br />Development Agreement will be carried out by a company that has for over 50 years <br />met in a first class manner its obligations in hundreds of owned and constructed <br />developments.
