The Planning Commission asked staff to explain <br />questions relating to the following: sidewalk and bike path; lot sizes; <br />the Taco Bell parking situation; traffic LOS; anticipated traffic <br />increase in Elk River regardless of this proposal. <br /> <br />Chairman Minton asked Peter Beck, City Attorney, to respond to the <br />questions of rezoning the proposed site. Mr. Beck replied that this <br />proposal must be addressed with the current zoning. <br /> <br />Ken Anderson, Engineer, asked the Planning Commission to at lease <br />consider this proposal without degrading the current roadway system. <br /> <br />COMMISSIONER SPOTTS RECOMMENDED APPROVAL OF THE CONDITIONAL USE PERMIT <br />REQUESTED BY ELK RIVER ASSOCIATES TO DEVELOP A 50 ACRE SITE AS A <br />COMMERCIAL PLANNED UNIT DEVELOPMENT BASED ON THE FOLLOWING FINDINGS FOR <br />APPROVING A CONDITIONAL USE PERMIT: <br /> <br />e <br /> <br />A. <br /> <br />THE PROPOSED USE WILL NOT ENDANGER, INJURE, OR DETRIMENTALLY <br />AFFECT THE USE AND ENJOYMENT OF OTHER PROPERTY IN THE IMMEDIATE <br />VICINITY OR THE PUBLIC HEALTH, SAFETY, MORALS, COMFORT, <br />CONVENIENCE, OR GENERAL WELFARE OF THE NEIGHBORHOOD OR THE CITY. <br /> <br />B. IT IS IN HARMONY WITH THE GENERAL PURPOSE AND INTENT OF THE ZONING <br />ORDINANCE AND THE COMPREHENSIVE PLAN. <br /> <br />C. <br /> <br />IT WILL NOT IMPEDE THE NORMAL AND ORDERLY DEVELOPMENT <br />IMPROVEMENT OF THE SURROUNDING VACANT PROPERTY, THEREBY <br />SERIOUSLY DEPRECIATING SURROUNDING PROPERTY VALUES. <br /> <br />AND <br />NOT <br /> <br />D.
