<br />FROM LRRKIH & HOFFMRH <br /> <br />9.24.1993 11:52 <br /> <br />P. 2 <br /> <br />RESOLUTION 93 - <br /> <br />e <br /> <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION APPROVING NOTICE OF PUBLICATION OF OFFICIAL <br />SUMMARY OF ORDINANCE NO. 93- AN ORDINANCE OF THE CITY OF <br />ELK RIVER, MINNBSOTA, REPEALING SECTION 704, OF THE CITY <br />CODE, SAUNAS AND MASSAGE ESTABLISHMENTS, AND ENACTING A NEW <br />SECTION 704 IN LIEU THEREOF RELATING TO THE SAME SUBJECT <br />ENTITLED THERAPEUTIC MASSAGE AND SAUNA ESTABLISHMENTS. <br /> <br />e <br /> <br />WHEREAS, The City Council of the City of Elk River has adopted <br />an ordinance pursuant to which Section 704 of the City <br />of Elk River Code of Ordinances, Saunas and Massage <br />Establishments, has been repealed and a new section <br />704 adopted in lieu thereof, entitled Therapeutic <br />Massage and Sauna Establishments; and <br /> <br />WHEREAS, The following is a summary of new Section 704 as <br />adopted in Ordinance No. 93-__: <br /> <br />1. The Ordinance sets forth a statement of purpose <br />to prohibit massage businesses and services to <br />the public except those licensed as Therapeutic <br />Massage Establishments and Massage Therapists <br />pursuant to the new section. <br /> <br />The Ordinance adopts new definitions of <br />Therapeutic Massage, Therapeutic Massage <br />Establishment, On-Site Therapeutic Massage, Sauna <br />and Massage Therapist. <br /> <br />2. <br /> <br />3. The Ordinance requires a license for a <br />Therapeutic Massage Establishment or Sauna open <br />to the public. The Ordinance provides for <br />license application requirements, provisions for <br />renewals and exceptions to the business license <br />requirements for licensed health care facilities, <br />medical clinics or hospitals, chiropractors, <br />osteopaths, podiatrists, physical therapists, and <br />beauty parlors or barbershops. <br /> <br />4. The Ordinance provides for restrictions and <br />regulations in the operation of Therapeutic <br />Massage Establishments. <br /> <br />5. The Ordinance sets forth requirements for the <br />issuance of licenses, including insurance <br />requirements. <br /> <br />6. <br /> <br />The Ordinance provides for individual Massage <br />Therapists to be licensed and sets forth <br />application and educational and training <br />requirements for the issuance of such licenses. <br /> <br />e <br />
