<br />rll ---\) <br />( )j <br />rl~ <br /> <br />ITEM 5.4. <br /> <br /> <br />TO: <br /> <br />FROM: <br /> <br />MAYOR AND CITY COUNCIL <br />GARY SCHMITZ, ZONING ASSISTANT ~~~ <br /> <br />DATE: SEPTEMBER 20, 1993 <br /> <br />SUBJECT: ABOVE GROUND STORAGE TANK <br /> <br />REQUESTED ACTION <br /> <br />Bill Dickenson, who owns the bus terminal located at 19101 <br />Jackson Road, is requesting to add a 10,000 gallon, insulated, <br />double-wall above ground storage tank to his bus terminal. The <br />tank will be used to replace two underground storage tanks, <br />which are approximately 30,000 gallons in combined size. <br /> <br />The reason that this item is being presented to the City <br />Council is that the State Fire Marshalls Office requires a <br />State variance for any above ground storage tank larger than <br />6,000 gallons. Part of the State variance procedure is to show <br />through certified minutes that this item has been reviewed and <br />approved by the City Council. <br /> <br />e <br /> <br />The City Council has the right to either deny the request, <br />approve the request with more stringent requirements, or to <br />approve the request and use the State standards for the <br />placement of the above ground storage tanks. The State <br />standards for above ground storage tanks are as follows: <br /> <br />1. The tank must be located 50 feet from any buildings. <br /> <br />2. The tank must be located 50 feet from any type of <br />dispenser (gas pump). <br /> <br />3. The tank must be located 50 feet from any public <br />right-of-way. <br /> <br />4. The tank must be located 100 feet from any property <br />line. <br /> <br />Mr. Dickenson wants an above ground tank because leaks and <br />other problems will be easier to detect and fix, versus the <br />underground tanks he currently has. This particular 10,000 <br />gallon storage tank is also portable, which will allow Mr. <br />Dickenson to move (if, and when his bus terminal is moved for <br />the placement of another commercial use). <br /> <br />e <br /> <br />Lastly, new laws require that existing storage tanks meet new <br />State standards. It is Mr. Dickenson's opinion that to update <br />his underground storage tanks to meet new State requirements <br />would cost several thousand dollars.
