LESTER BOELTER'S APPEAL OF <br />THE REFUSE AND GARBAGE APPEAL <br />BOARD DECISION <br /> <br />Mrs. Lester Boelter, 20733 Elk Lake Road, Elk River, came <br />before the Refuse & Garbage Appeal Board on August 10, 1992, to <br />discuss an exemption from mandatory refuse and recycling <br />service. The reason for the appeal request was financial <br />hardship and the fact that they have very little refuse. <br /> <br />e <br /> <br />The Boelter's are on a fixed income and have indicated they can <br />not handle an added bill. Mrs. Boelter recently explained that <br />the majority of their income is spent on medical supplies for <br />Mr. Boelter. The Appeal Board voted in a split decision to <br />deny the request to remain consistent throughout the City. <br />There are several people in the City who have a similar <br />situation and who are required to pay for refuse service. It <br />is the Appeal Board's feeling that if this request were <br />approved it would open the opportunity of several additional <br />requests. The Boelter's were delivered a container and billed <br />for the service. <br /> <br />Recently Mrs. Boelter contacted the City asking the Appeal <br />Board to again review their request for exemption. It is <br />staff's opinion that this request has already been heard by the <br />Appeal Board, therefore, the next step would be to appeal the <br />Decision of the Appeal Board to the City Council. <br /> <br />The City must keep in mind that the State Legislature requires <br />cities with a population over 1,000 people to ensure that <br />everyone has refuse collection service. The City of Elk River <br />has designed the biweekly refuse program to try and help the <br />low volume generator of refuse.
