Steve has <br />asked me to advise the Council of its options for correcting this <br />error. <br /> <br />Minnesota Statutes Section 462,358 requires that a public hearing be <br />held on plat approvals, following publication of notice of the time <br />and place of the hearing. The published notice typically includes the <br />legal description of the property to be platted. In this case, the <br />published notice did not include any indication that the plat included <br />a portion of Block 12, Lot 1, Barrington Hills. It is my <br />understanding that Lot 12 is already substandard in terms of land <br />area, and that taking part of Lot: 12 for Bruce Addition will make Lot <br />12 somewhat smaller. My concern is that it is possible someone from <br />the public may have objected to the plat on the grounds that it <br />reduced the size of Lot 12, but had no notice of this fact and no <br />opportunity to be heard on the subject. However, I recognize that it <br />is extremely unlikely this would have been the case. <br /> <br />Minnesota Statutes Section 505.03 requires every plat to have a full <br />and accurate description of the land platted. The plat for Bruce <br />Addition does not comply with this requirement. However, Minnesota <br />~tatutes Section 505.174 provides that a plat which has been executed <br />d filed in the Office of the County Recorder which fails to identify <br />
