RESOLUTION 93 - RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION APPROVING NOTICE OF PUBLICATION OF OFFICIAL SUMMARY OF ORDINANCE NO. 93- AN ORDINANCE OF THE CITY OF ELK RIVER, MINNESOTA, AMENDING SECTION 704 OF THE CITY CODE, OTHER BUSINESS REGULATIONS AND LICENSING, BY REPEALING SECTION 704, SAUNAS AND MASSAGE ESTABLISHMENTS, AND ENACTING A NEW SECTION 704 IN LIEU THEREOF RELATING TO THE SAME SUBJECT ENTITLED MASSAGE AND SAUNA ESTABLISHMENTS. WHEREAS, Section 704 of the City of Elk River Code of Ordinances Saunas and Massage Establishments is hereby repealed and a new section adopted in lieu thereof titled Massage and Sauna Establishments; and, WHEREAS, a statement of purpose was adopted to prohibit massage businesses and services to the public except those licensed as therapeutic massage enterprises and therapists pursuant to the new Section; and, WHEREAS, the Ordinance adopted new definitions of massage, massage establishment, sauna and massage therapist; and, WHEREAS, the Ordinance requires a license for a massage establishment or sauna open to the public. The Ordinance provides for license application requirements, provisions for renewals and exception to business license requirements for licensed health care facilities, medical clinics or hospitals, chiropractors, osteopaths, podiatrists, physical therapists, and beauty parlors or barbershops; and, WHEREAS, the Ordinance provides for restrictions and regulations; and, WHEREAS, the Ordinance provides for maintenance requirements and insurance requirements; and, WHEREAS, the Ordinance provides for individual masseur and masseuse licensing for qualified individuals meeting educational and training requirements; and, WHEREAS, the Ordinance establishes penal provisions for violations. A printed copy of the Ordinance is available for inspection by any person in the office of the City Clerk or the Elk River Public Library.
