(ERL), to operate a thermal soil processing <br />facility (the Facility) ae-on the following-described real <br />properties (hereinafter referred to as the ConTeck Property) <br />located within the permitted area of the Elk River Landfill <br />Site (ERL Site) situated in the City of Elk River: <br /> <br />[LEGAL DESCRIPTION TO BE ADDED] <br /> <br /> <br />WHEREAS, the City adopted an amendment (the Amendment) to <br />its zoning ordinance authorizing the designatingen ef-the ERL <br />Site a Solid Waste Facility (SWF) district effective <br />January 20, 1987; and <br /> <br />WHEREAS, Permittee will operate a facility for the <br />processing and treatment of soils contamina~ed' with petroleum <br />hydrocarbon on the ConTeck Property Landfill en Tract D in the <br />location as-shown on the site plan:-submitted ~ith the <br />application dated February 5, 1990; and <br /> <br />t' ':, <br /> <br />[!
