<br />CU 06-13 <br />June 19, 2006 <br />Page 3 <br /> <br />The minimum setback for off street parking for non residential uses in residential zones is 10 <br />feet. The parking area should be setback a minimum of 10 feet from the property line. <br />While two drives are permitted, the total width at the property line must not exceed 40 feet. <br /> <br />Additionally, the parking area should not impose on any existing or future septic areas. <br /> <br />Standards for Issuance of a Conditional Use Permit (Section 30.654) <br /> <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed <br />location: <br /> <br />1. Will not endanger, i,!jure or detrimentalfy a.ffect the use and e,!jqyment of other proper(y in the <br />immediate vicinity or the public health, sqfety, morals, comfort, convenience or general welfare of the <br />neighborhood or the city. <br />2. Wzll be consistent with the comprehensive plan. <br />3. Will not impede the normal and orderfy development and improvement of surrounding vacant <br />proper(y. <br />4. Will be seroed adequatefy by and will not adversefy a.ffect essential public facilities and semices <br />including streets, police and fire protection, drainage, refuse disposal, water and sewer .rystems, parks <br />and schools; and will not, in particular, create traffic congestion or inteiference with traffic on <br />acfjacent and neighboring public thoroughfares. <br />5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will <br />be detrimental to a'!)' persons or proper(y because of excessive traffic, noise, smoke, fumes, glare, <br />odors, dust or vibrations. <br />6. Will not result in the destruction, loss or damage of a natural, scenic or historic ftature of mqjor <br />importance. <br />7. Will fulfy compfy with all other requirements of this Code, including a'!)' applicable requirements <br />and standards for the issuance of a license or permit to establish and operate the proposed use in the <br />city. <br /> <br />If denial of such a permit should occur, it shall accompany recommendations or <br />determinations by findings or a report stating how the proposed use does not comply with <br />the standards set forth in Section 30-654. <br /> <br />Planning Commission discussion <br /> <br />The Planning Commission held a public hearing on June 13, 2006. Other than the applicant, <br />no one was there. to speak for or against the request. <br /> <br />Recommendation <br /> <br />On a 7-0 vote, the Planning Commission recommends approval of the request with the <br />following conditions: <br /> <br />1. Parking be setback a minimum of 10 feet from the property line <br />2.
