THE CONCERNS OF THE GUN CLUB BE CONSIDERED. <br />Staff feels that a fence between this plat and the <br />Gun Club with signage is appropriate, but it should <br />be the responsibility of the Gun Club. <br /> <br />9. NOTICE OF THE GUN CLUB EXISTENCE IS MADE OF RECORD <br />SO THOSE PURCHASING LOTS ARE AWARE. <br />The City Attorney is not recommending that a document <br />putting purchasers of lots in the plat on notice of <br />the Gun Clubs existence, be made of record. The <br />Attorney is concerned about setting a precedent. <br /> <br />10. THAT THE PUBLIC IMPROVEMENTS ARE SECURED BY A 100% <br />LETTER OF CREDIT PRIOR TO RECORDING THE PLAT (OR <br />WHATEVER PERCENTAGE IS CITY POLICY) PLUS A WARRANTY <br />BOND IN THE AMOUNT OF 25% OF THE COST OF THE PUBLIC <br />IMPROVEMENTS IS PROVIDED TO THE CITY FOR A 1 YEAR <br />PERIOD AFTER CITY ACCEPTANCE OF THE PUBLIC <br />IMPROVEMENTS. <br /> <br />. <br /> <br />11. THE IMPROVEMENTS IN THIS PLAT HAVE A COMPLETION DATE <br />OF ONE YEAR FROM THE DATE OF COUNCIL FINAL PLAT <br />APPROVAL. <br /> <br />12. A DEVELOPERS AGREEMENT IS ENTERED INTO REFLECTING <br />THE STIPULATIONS OF APPROVAL. <br /> <br />13. THE DEVELOPER MUST REIMBURSE THE CITY FOR THE COST <br />OF REVIEWING THE PLAT PRIOR TO FINAL PLAT REVIEW. <br /> <br />14. <br /> <br />THE TEMPORARY CUL-DE-SAC IS <br />END OF LOT 4, AND IS MADE FULL <br />THAT FALLS OUTSIDE OF THE 60 <br />BE SECURED BY TEMPORARY <br />AUTOMATICALLY RELEASED WHEN THE <br /> <br />EXTENDED TO THE NORTH <br />SIZE. THIS PLAT IS CONTINGENT UPON A VARIANCE BEING <br />GRANTED FOR THE ROAD IN THE PLAT. <br /> <br />VARIANCE <br /> <br />. <br /> <br />Staff refers the City Council to Section 900.40 of the Elk <br />River Code of Ordinance for the 5 standards to consider when <br />reviewing a variance request. The Planning Commission felt the <br />applicant met these 5 standards and is recommending approval of <br />this variance request to allow the road in the plat to encroach <br />on the maximum length of a dead-end (as shown on the plat <br />drawing). The Planning Commission's recommendation also <br />included the following stipulations: <br />
