<br />. <br /> <br />. <br /> <br />. <br /> <br />Easement Vacation, Richard Foster <br />February 19, 1993 <br /> <br />Page 2 <br /> <br />Hagen, vendees of a contract for deed and Gary <br />and Karen Archambault and Daniel and Teresa <br />Diebel, vendors of that contract for deed. This <br />easement would also be replaced when the property <br />is platted resulting in a permanent dedication. <br /> <br />Map F <br /> <br />This map shows the new alignment of 193rd Avenue <br />and Dodge Street with all the easement and <br />right-of-way dedications in place. <br /> <br />Staff is recommending approval of vacating <br />right-of-way as proposed by the applicant with <br />stipulations: <br /> <br />that portion of <br />the following <br /> <br />1. The plat of CherryHill Bluffs is recorded prior to <br />the easement vacation being recorded. <br /> <br />2. Other required easements are obtained for 193rd <br />Avenue prior to the vacation being recorded. Further, <br />these easements are 50 ft in width from center line. <br /> <br />3. City Attorney's review of legal descriptions and <br />title work. <br /> <br />A resolution is attached reflecting approval of this easement <br />vacation. <br /> <br />The last issue with this easement vacation is that Mr. Foster <br />is requesting the $150.00 fee be waived. Mr. Foster contends <br />the City is already rece1v1ng benefit with the new road <br />alignments being dedicated and the vacation should also be part <br />of the City's responsibility. Staff is holding Mr. Foster's <br />check for this fee until a determination is made by the City <br />Council. <br />
