Box 800 <br />Elk River, MN 55330 <br /> <br />Dear Mr. Martin: <br /> <br />On behalf of Mayor Jim Tralle, I would like to acknowledge <br />receipt of your November 20, 1992, letter regarding the <br />potential purchase by UPA of some of the old City Hall <br />property. The City was pleased to have received a written <br />proposal from UPA following our discussions this past summer. <br /> <br />In response to the six items listed in your November 20, 1992, <br />~ letter, the following comments are offered. <br /> <br />1. The City will need to retain a public easement across the <br />western part of UPA Drive so that the public that uses the <br />"park and ride" has access from Main Street through the <br />driveway that goes down the hill into the parking area <br />(item #3). <br /> <br />2. The City will agree to some type of restrictive covenants <br />on the balance of the property not acquired by UPA, but <br />the City needs to preserve the right to use the retained <br />property in a governmental or a quasi governmental manner <br />or by a nonprofit organization (item #5). <br /> <br />By this, I mean it may be possible that a Chamber of <br />Commerce building gets located on this property or, in the <br />future, some type of City government or school building <br />may be located on this property. <br /> <br />3. <br /> <br />The City cannot agree to any provision that would restrict <br />the authority or power of a future City Council to <br />regulate the access from UPA Drive to Main Street (item <br />#4) . <br /> <br />~ <br /> <br />It is difficult to imagine a situation that could arise <br />where the City Council would find it necessary to use its <br />authority to restrict access from UPA Drive to Main <br />Street, but that power rests solely with the City Council <br /> <br />720 Dodge Avenue N.W., Elk River, Minnesota 55330 (612) 441-7420 <br />
