Mr. Moldenhaurer <br />has expressed interest in platting his property, however, <br />nothing official has been applied for. There would be a <br />gap between the right-of-way of County Road 30 and the <br />trail proposed by the developers of Heritage Landing until <br />Mr. Moldenhaurer plats and subsequently dedicates land for <br />this connection. <br /> <br />Issue <br /> <br />Should this trail system be located between these <br />subdivisions and, consequently, in people's back yards, or <br />along a road system where traffic is expected (along the <br />proposed Gary Street in this plat or along a future road <br />further east on Mr. Moldenhaurer's land)? Also, consider <br />whether or not Outlot B as proposed by the developers or <br />l80th Avenue should be the connection from Heritage <br />Landing to this trail system. This issue should be <br />specifically addressed in your recommendation to the City <br />Council on this plat. <br /> <br />* * * * * * * * <br /> <br />The trail as proposed accesses the west end of the future <br />area wide park along the Mississippi. There will be other . <br />accesses as well as internal trails needed in this area <br />wide park. <br /> <br />Issue <br /> <br />Should these internal trails connect to the downtown river <br />walk and, if so, how would they cross the Elk River? This <br />issue does not directly relate to your review of this plat. <br /> <br />B. OWNERSHIP <br /> <br />Issue <br /> <br />(. <br /> <br />Who should have fee ownership of the land underlying the <br />trail? There are two alternatives to who owns the land: <br />1) the land the trail is situated on could be made part of <br />the individual lots with the City having rights to use <br />this land as a trail through easement. Consider whether <br />or not it would be right to have individual lot owners <br />paying taxes on land and having personal liability for <br />land used as a public trail; 2) the trail could be <br />dedicated to the City through the platting process so the <br />City has fee ownership. Staff feels this is the most <br />reasonable option. <br /> <br />. <br />
