<br />Case File: CU 06-13 <br />Page 3 <br /> <br />The revised plans also indicate that curbing, landscaping and signage will be added in front <br />of the loading bay closest to the exit of the drive lane. This will allow vehicles to exit the <br />drive-thru land even if a tractor trailer is parked at the other loading bay. <br /> <br />Standards for Issuance of a Conditional Use Permit (Section 30-654) <br /> <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed <br />location: <br /> <br />1. Will not endanger, i1'!Jure or detrimentallY affect the use and er!fqyment rif other properry in the <br />immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare rif the <br />neighborhood or the city. <br />2. Will be consistent with the comprehensive plan. <br />3. Will not impede the normal and orderlY development and improvement rif surrounding vacant <br />properry. <br />4. Will be served adequatelY f?y and will not adverselY qffect essential public facilities and services <br />including streets, police and fire protection, drainage, refuse disposal, water and sewer !}stems, parks <br />and schools; and will not, in particular, create trqffic congestion or inteiference with trqffic on <br />acfjacent and neighboring public thoroughfares. <br />5. Will not involve uses, activities, processes, materials, equipment and conditions rif operation that will <br />be detrimental to af!)! persons or properry because rif excessive trqffic, noise, smoke, fumes, glare, <br />odors, dust or vibrations. <br />6. Will not result in the destruction, loss or damage rif a natural, scenic or historic feature rif mqjor <br />importance. <br />7. Will fullY complY with all other requirements rif this Code, including af!)! applicable requirements <br />and standards for the issuance rif a license or permit to establish and operate the proposed use in the <br />city. <br /> <br />If denial of such a permit should occur, it shall accompany recommendations or <br />determinations by findings or a report stating how the proposed use does not comply with <br />the standards set forth in Section 30-654. <br /> <br />Plannin~ Commission Actions <br /> <br />Noone spoke at the public hearing. <br /> <br />The major issues discussed were the stacking room of cars in the drive lane and the sight <br />lines for customers exiting the drive lane with a tractor trailer parked in the loading bay.
