Applicants Narrative and Attachments <br /> <br />Overview <br /> <br />In December of 2004, the City Council approved an Ordinance Amendment which <br />increased the number of agricultural animals, to no more than twice currently allowed, <br />provided there is an approved manure management plan following the Minnesota Pollution <br />Control Agency Technical Guidelines for Manure Management and Applications and a <br />Conditional Use Permit (CUP). <br /> <br />The applicant is requesting a CUP to have 15 horses on a 10-acre site. They are proposing <br />an 8-acre pasture area on the western 2/3 of the property. This 8-acre area could allow for <br />up to 16 horses with a CUP. There is a one acre manure management site proposed to be <br />located in the northeast portion of the site with additional land area within the 8-acre pasture <br />area. The applicant has stated that approximately 60% of the manure will be spread in the <br />pastures and they keep the animals off of it for approximately 3-weeks to allow the manure <br />to break down and work into the soil. <br /> <br />They have put together a manure management plan which does meet Minnesota Pollution <br />Control Agency Technical Guidelines for Manure Management and Applications. <br /> <br />The City ordinance requires that all agricultural animals shall be provided a shelter under <br />roof appropriately size to accommodate the specific animal in a humane manner. The <br />applicant has provided two 12x24 shelter for the horses. <br /> <br />The applicant's narrative (with this CUP) discusses the desire to build and operate a riding <br />arena also. Since the time of the application submittal, it was realized that the size of the <br />property was reduced from 10-acres to approximately 9.8-acres. This was due to the fact <br />that Sherburne County obtained additional right-of-way along the eastern portion of the site <br />for their County Road 13 project. The applicant will be applying for a variance to the <br />allowable Accessory Structure size. At 10-acres, they could build an 8,000 sqft building. <br />Once they are in the 5 to 10-acre size, they can only build a 4,000 sqft building. <br /> <br />Standards for Issuance of a Conditional Use Permit (Section 30-654) <br /> <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed <br />location: <br /> <br />1. Will not endanger, i,!jure or detrimentallY c:iffect the use and e'!Jqyment of other propertY in the <br />immediate vicinity or the public health, sq[ety, morals, comfort, convenience or general welfare of the <br />neighborhood or the city. <br />2.
