Commissioner Fox as.ked if he had discussed this <br />with his neighbors and he said there were no objections. The public <br />portion was then opened. Richard Vagts, a neighbor to the east said <br />he has no objections to the proposed building. The public portion was <br />then closed. COMMISSIONER HINKLE MOVED APPROVAL OF A REAR YARD VARIANCE <br />DOWN TO SIX FEET FROM THE REAR YARD LINE. COMMISSION LUCAS AND DRIESSEN <br />SECONDED THE MOTION. MOTION PASSED 4-0. <br /> <br />6. G.M. Investment - Jack Menkveld, Conditional Use Permit <br /> <br />Jack Menkveld was not present to discuss this request for a condtional use <br />permit for a used car/truck business. The public portion of the hearing <br />was then opened. Alice Quist stated she was not in favor of this proposal. <br />She stated the Mr. Menkveld was known for applying for one thing and then <br />operating something else. She also said he was suppose to have moved off <br />the Ar-Mon property years ago, and gotten rid of the pigs; now the pigs are <br />back and he is building some log buildings on the property south of Highway <br />#lO. She also stated the used car lot next to there was neat and clean <br />and nothing but used cars. The public portion was then closed. Commissioner <br />Tracy asked Mr. Adolphson about a number of letters sent to Menkveld dating <br />back to November 1979. Mr. Adolphson said the City was trying to get Mr. <br />Menkveld to clean up the property and that Mr. Menkveld finally came in <br />and made the application for the conditional use permit and nothing has <br />been done since a March 7, 1980 letter regarding cleanup. Commissioner <br />Fox stated there has been no compliance on Mr. Menkveld1s part. Mr. <br />Adolphson stated if he does not comply, it will be turned over to the City <br />Attorney. He also stated that the City had written to Hardrives, Inc. of <br />St. Cloud regarding their contract with the Ar-Mon Properties for <br />construction, site grading, streets and drainage. COMMISSIONER DRIESSEN <br />MOVED THAT THE REQUEST FOR THE CONDITIONAL USE PERMIT BE DENIED. CO}frfISSIONER <br />LUCAS SECONDED THE MOTION. MOTION PASSED 4-0. <br /> <br />7. David Hauan's Discussion <br /> <br />David Hauan brought up his objections to being shut down when H & S was <br />leveling a hill on his property. He said he questioned the Commission's <br />policies and that it was half done when he was shut do\vn and it now <br />presents an eyesore. The Commission said that he has to go through the <br />proper channels and get a license, as it is considered mining, and also <br />a conditional use permit. Commissioner Fox stated that these rules and <br />regulations were set up for the benefit of the entire community. <br /> <br />8.
