<br />RESOLUTION NO. 06 - <br /> <br />CITY OF ELK RIVER <br />A RESOLUTION EXTENDING PRELIMINARY PLAT APPROVAL FOR: <br /> <br />Pinewood Estates 2nd Addition <br /> <br />Case No. P 05-13 <br /> <br />WHEREAS, application has been made for preliminary plat approval, pursuant to <br />Article V. Subdivisions, Sec. 30-373 of the Elk River City Code of Ordinances, of the <br />property legally described on attached Exhibit A and hereinafter referred to as "the <br />Property"; and <br />WHEREAS, the application for preliminary plat approval has been referred to the <br />Planning Commission which has given its advice and recommendation to the City Council; <br />and <br /> <br />WHEREAS, a preliminary plat of the Property was approved by the City Council on <br />October 17, 2005; and <br />WHEREAS, Sec. 30-374 of the Elk River City Code of Ordinances states that failure <br />to submit for final plat within one year of preliminary plat approval, unless the City Council <br />grants an extension, shall cause the preliminary plat to become null and void; and <br />WHEREAS, the City Council, pursuant to Sec. 30-374 of the Elk River City Code of <br />Ordinances, finds that good cause exists for the extension of the preliminary plat approval <br />and that the preliminary plat approval should be extended; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF ELK RIVER, as follows: <br /> <br />1. It is hereby determined by the City Council for the City of Elk River that good cause <br />exists for the extension of the preliminary plat approval and said approval shall be <br />extended to October 17,2013 <br /> <br />The foregoing resolution was introduced by Council Member and <br />duly seconded by Council Member . The following voted in favor of <br />the Resolution. <br />
