Planning Commission Minutes <br />Page 3 <br /> <br />February 14, 2006 <br />--------------------------- <br /> <br />4.THE VEHICLES SHALL BE DISPLAYED IN THE SIX STALLS ACROSS <br />THE DRIVE LANE FROM THE FRONT ENTRANCE, AS INDICATED ON <br />STAFF EXHIBIT A. <br /> <br />5.SIGNAGE SHALL BE INSTALLED AT EACH OF THE SIX PARKING <br />STALLS INDICATING THAT ONLY THESE STALLS CAN BE USED FOR <br />AUTOMOBILE SALES FOR HOLDER OF THE CONDITIONAL USE <br />PERMIT AT THIS SITE. <br /> <br />6.NO MORE THAN SIX (6) RETAIL AUTOMOBILES SHALL BE <br />DISPLAYED OUTSIDE. <br /> <br />7.IF MORE THAN SIX (6) RETAIL AUTOMOBILES ARE TO BE <br />DISPLAYED OUTSIDE, THE APPLICANT SHALL APPLY FOR AN <br />AMENDMENT TO THE CONDITIONAL USE PERMIT. <br /> <br />8.THE BUILDING SHALL MEET ALL BUILDING CODES. <br /> <br />9.THE BUILDING SHALL MEET ALL FIRE CODES. <br /> <br />10.THE APPLICANT SHALL CONTACT THE BUILDING DEPARTMENT <br />REGARDING ANY CODE REQUIREMENTS RELATED TO <br />AUTOMOBILE SHOWROOMS. <br /> <br />11.ALL VEHICLES SHALL BE DELIVERED TO THE SITE UNDER THEIR <br />OWN POWER. <br /> <br /> MOTION CARRIED 4-2. Request by Briggs Construction for Land Use Amendment from Public/Semi-Public to <br />Highway Business, Public Hearing – Case No. LU 06-02 <br /> <br />5.3. Request by Briggs Construction for Zone Change from Single Family Residential to <br />Highway Commercial, Public Hearing – Case No. ZC 06-02 <br /> <br /> Senior Planner Scott Harlicker stated that Briggs Construction has requested the land use <br />amendment from Public/Semi-Public to Highway Business, and a zone change from Single <br />Family Residential to Highway Commercial for property located on the west side of Freeport <br />Street, north of parker Elementary and south of Elk Park Center. The property will be <br />considered for platting by the City Council at the February 21, 2006 City Council meeting. <br />Mr. Harlicker explained that is a “housekeeping” request to make the land use and zoning <br />consistent with the remainder of the property proposed to be platted as Alea Rae Addition. <br />Staff recommends approval of the request as presented. <br /> <br /> Chair Anderson opened the public hearing. There being no public comment, Chair <br />Anderson closed the public hearing. <br /> <br /> Commissioner Offerman stated that he felt the request made sense and recommended <br />approval. Commissioner Stevens concurred. Commissioner Scott questioned why the <br />property was currently zoned Public/Semi-Public. Mr. Harlicker explained that the property <br />is owned by the School District. <br /> <br />MOTION BY COMMISSIONER STEVENS AND SECONDED BY <br />COMMISSIONER OFFERMAN TO RECOMMEND APPROVAL/DENIAL OF <br />THE REQUEST BY BRIGGS CONSTRUCTION FOR LAND USE <br />AMENDMENT FROM PUBLIC/SEMI PUBLIC TO HIGHWAY BUSINESS, <br />CASE NO.
