Park & Recreation Commission Minutes Page 3 July 13, 2005 ------------------------------------ Commissioner Anderson asked if Mr. Maertz meant fee title versus easement. Mr. Maertz stated to take as much required land as needed and the rest in cash dedication. Staff could ask the developer to redraw the plat to show land needed and new easements. Commissioner Niziolek wanted to clarify the dotted lines on the plat map as the wet zones and asked if it is possible to ask the developer to designate everything outside the “wet zone” as a conservation easement to be able to do a future trail. Commissioner Anderson asked if there was a “conservation easement” who would own it; the individual lot owners/homeowners association or city and stated that there should be a fall back plan. Commissioner Nystrom withdraws first motion. MOVED BY COMMISSIONER ANDERSON AND SECONDED BY COMMISSIONER NYSTROM TO RECOMMEND OBTAINING EASEMENT RIGHT OF WAY ALONG CREEK WITHOUT USING PARK DEDICATION FUND AND LOOK AT USING PARK DEDICATION TO ACQUIRE LAND FOR TRAIL WITH 50 FEET FROM CENTERLINE OF DITCH AREA. WEST LINE WOULD BE 33 FEET OF LOT 7 AND NORTH OF LOT 7. MOTION CARRIED 4-0 5.c. Request by City of Elk River for the Preliminary Plat of Northstar Business Park Chris Leeseburg, Planner/Parks Planner shared information regarding preliminary plat of Northstar Business Park for park dedication. Staff recommends cash dedication for approximately 32-acres of platted land. Commissioner Nystrom asked what the extent of property on the northeast corner was. Mr. Leeseburg stated it is a drainage pond. Commissioner Niziolek asked if the 33 feet outside the wet zone, on the west side and to the grade be “No-touch” zone. MOVED BY COMMISSIONER NYTSROM SECONDED BY COMMISSIONER ANDERSON TO SEEK TRAIL EASEMENT 33 FEET EAST OF WET LAND TO RAILROAD PROPERTY AND TO THE NORTH AND SOUTH PROPERTY LINES AND CASH DEDICATION. MOTION CARRIED 4-0 5.d. Request for a Preliminary Plat – Pinewood Estates 2 Addition nd Chris Leeseburg, Planner/Parks Planner shared information regarding preliminary plat of Pinewood Estates 2nd. Staff recommends cash dedication. Commissioner Anderson discussed that this area could have a trail system that eventually linked to the St. Cloud trail system and would like to know where the right away is. Commissioner Niziolek stated that this is a significant trail system and they should make it happen.
