Park & Recreation Commission Minutes Page 3 <br />July 13, 2005 <br />------------------------------------ <br /> <br />Commissioner Anderson asked if Mr. Maertz meant fee title versus easement. <br /> <br />Mr. Maertz stated to take as much required land as needed and the rest in cash dedication. <br />Staff could ask the developer to redraw the plat to show land needed and new easements. <br /> <br />Commissioner Niziolek wanted to clarify the dotted lines on the plat map as the wet zones <br />and asked if it is possible to ask the developer to designate everything outside the “wet <br />zone” as a conservation easement to be able to do a future trail. <br /> <br />Commissioner Anderson asked if there was a “conservation easement” who would own it; <br />the individual lot owners/homeowners association or city and stated that there should be a <br />fall back plan. <br /> <br />Commissioner Nystrom withdraws first motion. <br /> <br />MOVED BY COMMISSIONER ANDERSON AND SECONDED BY <br />COMMISSIONER NYSTROM TO RECOMMEND OBTAINING EASEMENT <br />RIGHT OF WAY ALONG CREEK WITHOUT USING PARK DEDICATION <br />FUND AND LOOK AT USING PARK DEDICATION TO ACQUIRE LAND FOR <br />TRAIL WITH 50 FEET FROM CENTERLINE OF DITCH AREA. WEST LINE <br />WOULD BE 33 FEET OF LOT 7 AND NORTH OF LOT 7. MOTION CARRIED <br />4-0 <br /> <br />5.c. Request by City of Elk River for the Preliminary Plat of Northstar Business Park <br /> <br />Chris Leeseburg, Planner/Parks Planner shared information regarding preliminary plat of <br />Northstar Business Park for park dedication. Staff recommends cash dedication for <br />approximately 32-acres of platted land. <br /> <br />Commissioner Nystrom asked what the extent of property on the northeast corner was. <br /> <br />Mr. Leeseburg stated it is a drainage pond. <br /> <br />Commissioner Niziolek asked if the 33 feet outside the wet zone, on the west side and to the <br />grade be “No-touch” zone. <br /> <br />MOVED BY COMMISSIONER NYTSROM SECONDED BY COMMISSIONER <br />ANDERSON TO SEEK TRAIL EASEMENT 33 FEET EAST OF WET LAND TO <br />RAILROAD PROPERTY AND TO THE NORTH AND SOUTH PROPERTY <br />LINES AND CASH DEDICATION. MOTION CARRIED 4-0 <br /> <br /> 5.d. Request for a Preliminary Plat – Pinewood Estates 2 Addition <br />nd <br /> <br />Chris Leeseburg, Planner/Parks Planner shared information regarding preliminary plat of <br />Pinewood Estates 2nd. Staff recommends cash dedication. <br /> <br /> Commissioner Anderson discussed that this area could have a trail system that eventually <br />linked to the St. Cloud trail system and would like to know where the right away is. <br /> <br /> Commissioner Niziolek stated that this is a significant trail system and they should make it <br />happen. <br /> <br />
