The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and community <br />engagement that encourages and inspires prosperity <br /> <br />Request for Action <br /> <br />To <br />City Council <br />Item Number <br />4.11 <br /> <br />Meeting Date <br />January 5, 2026 <br />Prepared By <br />Justin Femrite, Public Works Director/Chief Engineer <br /> <br />Item Description <br />Agreement 26-01 Meadowwoods Village Sewer <br />Acquisition <br />Reviewed by <br />Justin Femrite <br />Joseph Hale <br />Cal Portner <br />Jolene Richter <br /> <br />Action Requested <br />Approve, by motion, the Assignment and Assumption Agreement with the Meadowwoods Village <br />Homeowners Association (HOA) and Natural System Utilities (NSU) and payment of $220,000 for the <br />purchase of the existing private system. <br /> <br /> <br />Background/Discussion <br />Consistent with previous approvals relating to the connection of the Meadowwoods Village development to <br />the city-owned collection and treatment system, we have progressed with construction to the point of making <br />the final connection to the city system. <br /> <br />As detailed in Resolution 25-28 approved by the Council on June 16, 2025, costs for the existing system from <br />NSU have been included in the proposed and agreed-upon assessment amounts that will be levied on the <br />benefiting property owners. This item includes the approval of documents and payment to complete the <br />transaction. <br /> <br />The city attorney has worked with legal counsel from NSU and the HOA on the attached Assignment and <br />Assumption Agreement and recommends approval as a necessary step in the transaction. <br /> <br />Financial Impact <br />As the agreement details, the approval of this item includes the city, on behalf of the HOA, purchasing the <br />existing private system from NSU for $220,000 (an amount that has been negotiated between NSU and the <br />HOA). <br /> <br />Mission/Policy/Goal <br />Work with citizens to achieve goals <br /> <br />Attachments <br />1.
