Leave Benefits <br />The city and state and federal law provides leaves of absence according to the following <br />policies. A Leave Request f-tee form must be completed for foreseeable <br />leaves other than vacation. Forms are available on Access Elk River or from Human <br />Resources. When possible, advance notice of a leave should be provided to the employee's <br />department director so work schedules can be adjusted accordingly. Many types of leave <br />below have notice requirements. It is the employee's responsibility to review these policies <br />and follow the notice requirements. Notice is not considered given until a Leave Request <br />form has been submitted. <br />Depending upon an employee's situation, more than one form of leave may apply during <br />the same period ., the Family and MediEal Leave AEt is likely to apply during a workers' <br />Not all types of leave are compensated. Employees taking FMLA <br />leave are required to take vacation, sick, ESST, or compensatory time concurrently, unless <br />they are also taking MN Paid Leave. An employee will need to meet the requirements of <br />each form of leave separately and all eligible leaves will run concurrently, as allowed by <br />law. Leave requests will be evaluated on a case -by -case basis. <br />Employees shall record worked hours or use only one type of paid leave for each <br />scheduled work hour. Time off without pay is not allowed outside of the leave policies <br />below. <br />Except as otherwise stated, all paid time off taken under any of the city's leave programs <br />must be taken concurrently, or, when allowed by law, consecutively, with no intervening <br />unpaid leave. The city will provide employees with time away from work as required by <br />state or federal statutes if there are requirements for such time off that are not described <br />in the personnel policies. <br />The city will not discharge, discipline, penalize, interfere with, or otherwise retaliate or <br />discriminate against an employee for asserting leave rights in accordance with these <br />policies. <br />Vacation Leave <br />Paid vacation leave is provided for regular, full-time employees and on a prorated basis for <br />eligible part-time employees. To be eligible, part-time employees must work a set schedule <br />with a minimum of forty (40) hours per biweekly pay period. Most temporary, seasonal, <br />and part-time employees are not eligible for vacation benefits. <br />Vacation leave is accrued based on consecutive years of leave -eligible service. To <br />determine an employee's vacation accrual rate, years of service will include all continuous <br />time the employee has worked at the city in a position that is eligible for paid leave <br />(including authorized unpaid leave). Employees who are rehired after terminating city <br />employment will not receive credit for their prior service unless specifically negotiated at <br />the time of hire. <br />Page 20187 <br />Page 87 of 447 <br />
