employees (including temporary and part-time employees) performing work for the city
for at least 80 hours in a calendar year. Paid On -Call Firefighters and elected officials or
someone appointed to fill an elected office vacancy are not eligible.
Accrual of ESST
Beginning January 1, 2025, Minnesota law requires all leave time provided to employees
for personal illness or injury to be available for use as ESST. Regular, full-time and part-
time employees no longer accrue time into sick banks and accrue ESST at a rate of eight (8)
working hours for each calendar month, prorated for regular part-time employees.
(Employees with more than 960 hours of Sick and ESST, see Sick and ESST Bank Balances
for Regular Employees below.) To be eligible as a regular part-time employee, employees
must work a set schedule with a minimum of forty (40) hours per biweekly pay period.
For all non -regular employees, ESST is earned at the rate of one hour for every 30 hours
worked, up to a maximum of 48 hours earned per calendar year with a maximum bank
balance of 80 hours.
The hourly rate of ESST is the same hourly rate an employee earns from employment with
the city.
ESST may begin accruing at the beginning of employment although employees may not
use ESST until they have worked 80 hours. Unused ESST is not paid out at the end of
employment except as provided under Severance Pay above.
ESST may be used as it is accrued in the smallest increment of time for which employees
are paid. For employees recording work hours on a timesheet, ESST may be used in 15
minute increments. For employees punching in and out on a kiosk, ESST may be used for
the time lost in your scheduled shift.
An employee may use accrued ESST for the following reasons:
■ an employee's:
o mental or physical illness, injury, or other health condition;
o need for medical diagnosis, care, or treatment of a mental or physical
illness, injury, or health condition;
o need for preventive medical or health care; or
o need to make arrangements for or attend funeral services or a memorial, or
address financial or legal matters that arise after the death of a family
member;
■ care of a family member:
o with a mental or physical illness, injury, or other health condition;
o who needs medical diagnosis, care, or treatment of a mental or physical
illness, injury, or other health condition; or
o who needs preventive medical or health care;
absence due to domestic abuse, sexual assault, or stalking of the employee or
Page 22181
Page 176 of 447
