Choice of Remedv <br />It is specifically understood that any matters governed by statutory or regulatory <br />provisions, except as expressly provided for in the policy, shall not be considered <br />grievances under this policy. If more than one procedure is available for resolution of a <br />dispute arising from any provisions covered by the agreement, the aggrieved employee <br />shall be limited to one procedure through which remedy may be sought. If the aggrieved <br />employee utilizes a procedure other than the grievance procedure herein, then the <br />employee is precluded from appealing under this procedure. If the employee utilizes this <br />procedure, then the employee is precluded from appealing under another procedure. <br />Employees may use both this grievance procedure and a statutory procedure to the extent <br />that it is required by state or federal law. <br />Safety <br />The city seeks to ensure the personal safety of employees and to prevent occupationally <br />induced injuries and illnesses. To the greatest degree possible, management seeks to <br />maintain a safe and hazard -free work environment. <br />It is the policy of the City Council to provide employees with safe working conditions <br />through the following means: <br />A Safety Committee consisting of employees and management representing each <br />department and employee group is charged with creating and maintaining a safety <br />program in compliance with all applicable federal, state, and local laws. <br />The Committee or sub -committee reviews occupational illness and injury, and incidents <br />that result in damage to city property, and strives to take action to ensure that unsafe <br />work methods, unsafe work sites, and unsafe equipment are identified and made safe. <br />All employees are required to fully comply with the Safety Program as administered by the <br />Safety Committee. <br />Department directors, management, and supervisory employees are responsible for <br />implementing the Safety Program by training their employees in safe work methods and <br />by enforcing compliance with safety standards set by the Safety Committee. <br />Department directors are responsible for providing all employees with th-e-safety <br />equipment and safety clothing that is necessary for employees to perform their duties in a <br />safe manner. <br />New employees receive a copy of the City ofElk River Employee Safety Manua/during their <br />onboarding. Employees are required to read the manual carefully and discuss areas of <br />concern with their supervisor. Employees are required to develop safe work habits and to <br />contribute to the safety of themselves and co-workers. <br />Page 60187 <br />Page 131 of 447 <br />
