<br />229446v1 <br />state or federal law or agreed to in writing by the City and the Developer. Thereafter, notwithstanding <br />anything in this Contract to the contrary, to the full extent permitted by state law, the City may require <br />compliance with any amendments to the City’s Comprehensive Plan, official controls, platting or <br />dedication requirements enacted after the date of this Contract. <br /> 7. DEVELOPMENT PLANS. The Subdivision shall be developed in accordance with the <br />following plans (The Plans). The Plans shall not be attached to this Agreement. The City Engineer may <br />approve minor amendments to Plan B as requested by Developer without City Council approval. If the <br />Plans vary from the written terms of this Contract, the written terms shall control. The Plans are: <br /> Plan A - Plat <br /> Plan B - Final Grading, Drainage, and Erosion Control Plan & SWPPP dated ______, 2025, last revised <br />as of _______________, 2025. <br /> Plan C - Plans and Specifications for Public Improvements dated ______, 2025, last revised as of <br />_______________, 2025. <br /> Plan D – Landscape Plan dated ______, 2025, last revised as of _______________, 2025. <br />Plan E – Storm water Management Plan detailing long term ownership, maintenance schedules <br />and procedures for all stormwater facilities as required by the City’s MS4 permit <br /> <br /> Plan F – Development Plan (requirements described in Exhibit B) <br /> 8. IMPROVEMENTS. The Developer shall install and pay for the following: <br />A. Sanitary Sewer System (public) <br />B. Water System (public) <br />C. Storm Sewer System (public) <br />D.
