Supplemental Report <br />ICR:22022290 Last Modified:11-14-2025 1418 <br />Title:Citation Created By:David Williams <br />On Monday 12/05/22 I, Detective David Williams, was conducting tobacco compliance checks <br />throughout the city of Elk River. I performed this with the assistance of Mark Lees with Sherburne <br />County Health and Human Services and the person under the age of 21 who Lees had pre-selected. <br />See the miscellaneous officer report (22022287) for information on the identity of the purchaser. The <br />purchaser will be hereinafter referred to as “the buyer”. Lees had provided the buyer U.S. currency to <br />attempt to purchase tobacco products as part of the compliance checks throughout the evening. <br />At approximately 1725 hours the buyer entered Elk River Tobacco LLC (Tobacco+) located at 19262 <br />Evans St NW. Shortly thereafter, the buyer exited the business with a pack of Camel Turkish Silver <br />Classic cigarettes which she advised Lees and I that she purchased. The buyer turned over the pack of <br />cigarettes to me which I secured as evidence. <br />After completing the compliance checks, I brought the cigarettes back to the Elk River Police <br />Department where I secured it in my office and later entered into evidence on 12/06/22. I also took <br />photographs of the pack of cigarettes and uploaded it to evidence.com. <br />The buyer described the salesclerk to Lees and I at which time Lees and I entered the business and <br />made contact with the clerk who I identified by United States Passport as Yousef Noman Husein <br />DOB: 12/18/02. Husein advised he does not have a MN driver’s license. I later confirmed that Husein <br />did not have a MN driver’s license on file. <br />Husein admitted to selling the cigarettes to the buyer and knowing that it is illegal to sell tobacco <br />products to people under 21 years of age. Husein admitted to not asking for the buyer’s identification <br />or asking her age. Husein said he didn’t ask for her identification or age because he thought the buyer <br />looked older. <br />Lees talked with Husein about training he may have received from the employer in how to identify <br />underage subjects trying to purchase tobacco. Lees also advised Husein to follow the recommendation <br />of checking the identity of anyone suspected of being 30 years old or younger. <br />I activated my body worn camera while Lees and I were inside the business talking with Husein. <br />On 12/06/22 I issued Husein citation #71022022003681 for selling tobacco to a person under 21 years <br />of age (city ordinance 26.37.a).
