The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and community <br />engagement that encourages and inspires prosperity <br /> <br />Request for Action <br /> <br />To <br />City Council <br />Item Number <br />7.4 <br /> <br />Meeting Date <br />November 17, 2025 <br />Prepared By <br />Chris Leeseberg, Senior Planner <br /> <br />Item Description <br />Ordinance Amendment: Reasonable <br />Accommodation Appeal Process, City of Elk River <br />Reviewed by <br />Cal Portner <br />Tina Allard <br /> <br />Action Requested <br />Open the public hearing, receive comments, and continue the public hearing to January 20, 2026. <br /> <br /> <br />Background/Discussion <br />The Planning Commission reviewed the proposed Reasonable Accommodation Ordinance on October 28, <br />2025, and was concerned that individuals could use the appeal process for applications beyond the scope and <br />intent of the proposed ordinance — creating a potential variance loophole. They also had questions about <br />listing staff as the approver for the requests and the burden that places on them. <br /> <br />The Commission asked to have the city attorney attend their next meeting to answer their questions about <br />the proposed ordinance amendment. The city attorney is not available for the November Planning <br />Commission meeting, but will be in attendance on December 16, 2025. As a result, the Commission has not <br />provided a recommendation to the Council, and the Council may not act on the ordinance until after the <br />Commission. <br /> <br />Staff recommends the Council receive comments and then continue the public hearing to January 20, 2026. <br /> <br />Financial Impact <br />None <br /> <br />Mission/Policy/Goal <br />Ethical, efficient, and responsible. <br /> <br />Attachments <br />None <br /> <br /> <br />Page 238 of 379
