The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and community <br />engagement that encourages and inspires prosperity <br /> <br />Request for Action <br /> <br />To <br />City Council <br />Item Number <br />4.9 <br /> <br />Meeting Date <br />November 17, 2025 <br />Prepared By <br />Ryan Sandhoefner, Engineering Project Manager <br /> <br />Item Description <br />Agreement 25-33: Sherburne County for Mississippi <br />Road Trail <br />Reviewed by <br />Justin Femrite <br />Cal Portner <br />Tina Allard <br /> <br />Action Requested <br />Approve Agreement 25-33 between the City of Elk River and Sherburne County for improvements to the <br />Mississippi Road Trail. <br /> <br /> <br />Background/Discussion <br />As part of the Mississippi Road Trail Infill Improvements Project, permanent and temporary easements were <br />required from Parcel ID 75-00844-0020. This parcel is owned by Sherburne County, leading to the execution <br />of a Joint Powers Agreement between the City of Elk River and Sherburne County. We were granted a <br />temporary Right of Entry to construct the trail prior to Sherburne County Board approval, but a formal Joint <br />Powers Agreement is required to finalize the process. <br /> <br />The county will grant the city a 17-foot Permanent Trail Easement along the entire southern border of Parcel <br />ID 75-00844-0020 to facilitate the project, as described and shown on the attached Exhibit B. The county will <br />also grant a Temporary Construction Easement as described and shown on the attached Exhibit C. <br /> <br />Based on current-day land valuations, the city shall pay to the county the sum of $5,173.47 as consideration <br />for the Permanent Trail Easement described and shown on Exhibit B and the Temporary Construction <br />Easement sum of $234.31 described and shown on Exhibit C. <br /> <br />Financial Impact <br />The sum of two easements is $5,407.78 and is to be funded through the Park Dedication Fund. <br /> <br />Mission/Policy/Goal <br />Responsible for every dollar - good stewards. <br /> <br />Attachments <br />1.
