EXHIBIT B <br />CONDITIONS OF APPROVAL <br />1. Staff approval of all engineering, grading, utility, site, and landscape plans. <br />2. All park dedication requirements described the preliminary plat and planned <br />unit development approvals. <br />3. Park dedication shall be paid at an adjusted rate of $1,000 per lot. <br />4. The Water Availability Charge shall be paid prior to releasing the final plat. <br />5. The developer shall convey outlots A, C, and O to the city prior to releasing the <br />final plat. <br />6. Developer must coordinate the relocation or modification of overhead power <br />lines and poles with Elk River Municipal Utilities (ERMU). <br />7. Prior to releasing the Final Plat for recording, the Developer shall furnish a <br />boundary survey of the proposed property to be platted with all property corner <br />monumentation in place and marked with lath and a flag. <br />8. Council approval of a Development Agreement outlining the responsibilities of <br />the developer and the city. <br />9. A letter of credit equal to 100% the costs of the public improvements must be <br />provided prior to releasing the plat for recording. <br />10. Upon completion of all public improvements and acceptance by the city, a <br />security or warranty in a form acceptable to the Public Works Director must be <br />secured. <br />11. All wet stormwater basins require a 25-foot easement in accordance with <br />setback and buffer requirements outlined in Sec. 30-1852. The buffer must be <br />marked with approved signs. <br />12. Setback lines shown on all plans must reflect the 45-foot setback required for all <br />wet ponds. <br />13. Trails and other features within the floodplain must comply with the floodplain <br />ordinance standards. <br />14. All temporary dead ends included in future development plans must include <br />signage stating, "Future Through Street" and a temporary cul-de-sac when the <br />street will have driveway access. <br />15. The developer and the city must design and install access improvements at <br />Highway 10 and 165th Ave to support the traffic needs of the proposed <br />development. <br />16. Any item or condition found that indicates the site is likely to yield information <br />important to pre -history or history shall be reported to the city immediately. <br />Further, the city reserves the right to stop work authorized in its approval until <br />the site is appropriately investigated and work is authorized. <br />r�NATW, <br />I 1111 <br />L <br />
