The plight of the petitioner is due to circumstances <br />unique to the property not a consequence of the <br />petitioner's own action or inaction. <br />The property is currently 5 acres in size and a simple split would generally create two <br />2.5 acre lots. However, due to the need to dedicate right-of-way the lot sizes are <br />reduced by approximately 0.4 acres. <br />Additionally, the existing street does not have a cul-de-sac, and adding the public <br />improvement will bring the property into greater conformance with city standards. <br />This is not a consequence of the petitioner’s actions. <br />Page 82 of 83
