The plight of the petitioner is due to circumstances unique to the property, not a consequence of the <br />petition's own action or inaction; and <br /> <br />The property is currently 5 acres in size and a simple split would generally create two 2.5 acre lots. However, <br />due to the need to dedicate right-of-way, the lot sizes are reduced by approximately 0.4 acres. <br />Additionally, the existing street does not have a cul-de-sac, and adding the public improvement will bring the <br />property into greater conformance with city standards. This is not a consequence of the petitioner’s actions. <br /> <br />5.
