1. Purpose and Intent of Water -Oriented Structures <br />Staff calculated our proposal as 780 SF, "nearly double" the 400 SF allowance. <br />We respectfully clarify: the shed addition totals 460 SF, only +60 SF over <br />allowed. The deck is a replacement, not a water -oriented structure, and should <br />not be included in the calculation. <br />Our impervious coverage remains well below thresholds, and Lake Orono is <br />dam -controlled and regulated, minimizing runoff risk. <br />A berm lies between the structure and shoreline, providing natural screening. <br />In addition, our bay is shallow, secluded, and unused for recreation, meaning the <br />structure has virtually no public visibility. <br />Enclosing equipment reduces shoreline clutter, further supporting the ordinance's <br />intent to minimize impact. <br />2. Comprehensive Plan <br />The Plan emphasizes protecting resources and preserving residential use. Our <br />project consolidates storage, improving shoreline appearance and limiting clutter. <br />The structure is 125 feet from the shoreline, farther than many other existing or <br />permitted structures. <br />The project supports recreational residential use and aligns with the character <br />envisioned in the Plan. <br />3. Reasonable Use <br />A 100 SF shed is not reasonable for a family of five with multiple kayaks and <br />lake -use equipment. <br />Staff suggested other compliant areas exist, but wetlands and a city -held <br />stormwater easement/retention pond eliminate those options. <br />DNR representative James Bedell and City staff member Joseph Hale <br />confirmed during their site visit that this is the only feasible location. <br />4. Hardship and Unique Circumstances <br />Staff identified the hardship as "self-created." We respectfully disagree. <br />Our hardship stems from protected wetlands and a city -held stormwater <br />easement, which restricts usable land. We pay taxes on this land but cannot use <br />it. <br />This constraint is unique to our lot and not a result of our actions. <br />Page 43 of 83
