A variance may be granted by the board only if it finds that: <br />The variance is in harmony with the general purpose and intent of the ordinance <br /> <br />Yes <br /> <br />The variance is consistent with the City of Elk River Comprehensive Plan (discuss with city <br />staff if needed) <br /> <br />Yes <br /> <br />Variances may be granted when the petitioner establishes that there are practical difficulties <br />in complying with the zoning ordinance. Practical difficulties means that: <br />The petitioner proposes to use the property in a reasonable manner not permitted by the <br />zoning ordinance <br />Yes <br />Only asking for a 4.5 ft variance. The building next door, to the West is setback 10' from the <br />property line and it will still create some visibility problems by only moving our sign to the South by <br />only 4.5' The stoop at the South door of the adjoining property extends towards the street at an <br />equal distance. By granting a 4.5 ft variance the sign will not extend further than the stoop on the <br />building to the West as shown in our pictures. <br /> <br />The plight of the petitioner is due to circumstances unique to the property not a <br />consequence of the petition's own action or inaction; and <br /> <br />yes <br />This request is being ask due to circumstances that were not created by the variance applicant. The <br />building to the West was given a reduced set back which has created this needed variance of 4.5 ft. <br /> <br />The variance, if granted, will not alter the essential character of the locality <br /> <br />It will not alter the essential characteristics of the locality <br />Page 10 of 84
