On this day of <br />Temporary Construction Easement <br />County Project No. SP 071-596-011 <br />PID Number 75-00573-0020 <br />Sherburne County, Minnesota <br />72025. <br />FOR VALUABLE CONSIDERATION, The City of Elk River, a Minnesota Municipal Corporation, <br />Grantor(s), hereby grant to the County of Sherburne, Grantee, a Political subdivision of the State of <br />Minnesota, a temporary easement over and across real property in Sherburne County, described as <br />follows: <br />That part of OUTLOT B, MEADOWVALE HEIGHTS SECOND ADDITION, according to the <br />recorded plat thereof, Sherburne County, Minnesota, being further described as follows: <br />Commencing at the northeast corner of said OUTLOT B, thence south along the east line of said <br />OUTLOT B for 37.75 feet; thence deflecting 90 degrees to the right for 35.00 feet; thence deflecting 90 <br />degrees to the left for 40.00 feet; thence deflecting 90 degrees to the left for 35.00 feet to said east line <br />of OUTLOT B; thence north along said east line for 40.00 feet to the point of beginning and there <br />terminating. <br />EXCEPT PARCEL 44, SHERBURNE COUNTY HIGHWAY RIGHT OF WAY PLAT NO. 108, <br />according to the recorded plat thereof. <br />Said temporary construction easement shall be in effect for 12 months from the beginning of the project <br />and end 12 months after that date and agreed upon consideration paid to Grantor for said Temporary <br />Construction Easement. <br />GRANTOR(S) HEREBY AGREE to allow the grantee to alter the existing grade in the above - <br />described easement area to the extent necessary to properly grade the reconstruction project. <br />GRANTEE HEREBY AGREES that the easement area shall be restored to its original condition as <br />nearly as possible except for trees, shrubs and gardens.
