Request for Action <br />City of <br />Elk <br />River <br />To <br />City Council <br />Meeting Date <br />August 4, 2025 <br />Item Description <br />Resolution 25-42: Oakwater Ridge Environmental <br />Assessment Worksheet (EAW) Findings <br />Item Number <br />4.4 <br />Prepared By <br />Zack Carlton, Community Development Director <br />Reviewed by <br />Cal Portner <br />Tina Allard <br />Action Requested <br />Adopt Resolution 25-42 making a negative declaration of need for an Environmental Impact Statement (EIS) <br />for the Oakwater Ridge Subdivision. <br />Background/Discussion <br />Earlier this year, Capstone Homes submitted a complete Environmental Assessment Worksheet (EAW) for <br />their proposed residential development. The EAW review was required per Minnesota rules and evaluated <br />potential impacts on the environment that may be a result of residential subdivision. The city, acting as the <br />RGU, engaged WSB to assist in coordinating the formal review and public comment period with the <br />Environmental Quality Board and relevant outside agencies. The public comment period ran from May 20, <br />2025, to June 20, 2025. Staff received comments from two agencies during the comment period. <br />The applicant's consulting engineer prepared a formal response to comments, and staff reviewed the EAW, <br />public comments, and the response in their entirety to determine if a more intense environmental review <br />(Environmental Impact Statement) was required. The review and analysis do not identify a need for an <br />additional review, Environmental Impact Statement (EIS), and staff recommend Council adopt the attached <br />resolution affirming the findings.
