The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and community <br />engagement that encourages and inspires prosperity <br /> <br />Request for Action <br /> <br />To <br />City Council <br />Item Number <br />8.2 <br /> <br />Meeting Date <br />July 7, 2025 <br />Prepared By <br />Justin Femrite, Public Works Director/Chief Engineer <br /> <br />Item Description <br />Agreement 25-16: Cost Sharing for the TH 10 and <br />165th Avenue Intersection Improvements with <br />Capstone <br />Reviewed by <br />Justin Femrite <br />Cal Portner <br />Tina Allard <br /> <br />Action Requested <br />Approve, by motion, Agreement 25-16 Capstone Homes, agreeing to 50% of the costs associated with <br />engineering services for the preliminary and final design of the proposed improvements. <br /> <br />Approve, by motion, the execution of a professional services contract with Bolton & Menk, Inc. for $258,751 <br />for engineering services associated with the work detailed in the cost share agreement. <br /> <br /> <br />Background/Discussion <br />As discussed over the last several months in the planning process for the Oakwater Ridge development along <br />TH 10, the city has been provided the opportunity to participate in safety improvements along the TH 10/169 <br />corridor at the intersection of 165th Avenue. The State of Minnesota continues to apply its funding resources <br />to other priorities and is not in a position to participate. <br /> <br />As part of the needs for the development on the west side of the highway, the developer has proposed a 50% <br />cost split for the full improvement costs, asking for consideration by the city to cover the costs of the current <br />city-owned intersection leg at 165th Avenue. <br /> <br />It is intended to enter into the agreement at this time, ahead of an executed Development Agreement, to <br />allow for the design work to begin in anticipation of construction beginning in late 2026. <br /> <br />Financial Impact <br />Funding commitments associated with the current actions would obligate the City to $137,500 in professional <br />services costs. Added costs for construction would be considered and obligated under future approvals upon <br />bidding for the construction work.
