Council approval of a Development Agreement outlining the responsibilities of the city and developer. <br />2. A Letter of Credit shall be provided to the city in the amount of 100% of the costs of the public <br />improvements. <br />3. Upon completion of all improvements and acceptance by the city, a security or warranty in a form <br />acceptable to the public works director must be secured. <br />4. The Development Plan shall be approved by the public works director prior to the issuance of building <br />permits. <br />5. Staff approval of all site, civil, and landscaping plans. <br />6. Park Dedication Fee will be paid at a prorated amount based on the land dedication outlined in the <br />preliminary plat approval. <br />7. The developer shall deed Outlot C to the city as park dedication. <br />8. The typical street section shall be updated to include the sidewalk along the edge of the street. <br />9. Any item or condition found that indicates the site is likely to yield information important to pre- <br />history or history shall be reported to the city immediately. Further, the city reserves the right to stop <br />work authorized in its approval until the site is appropriately investigated and work is authorized. <br /> <br /> <br /> <br />Background/Discussion <br />The preliminary plat of Meadowsweet Bend was approved on September 16, 2024, and included 104 single- <br />family lots. All the lots will connect to the city's sewer system, but will have their own private wells. The <br />applicant, Twin City Land Development, is seeking approval of the first phase, which will plat 33 new single- <br />family lots and establish the first intersection with County Road 33. The intersection will align with Joplin <br />Street and construct new right and left-turn lanes into the subdivision. <br /> <br />This first phase is consistent with the preliminary plat approval, but staff have requested one change to the <br />street section to simplify maintenance of the required sidewalk. The development is being constructed using a <br />rural section, which has drainage ditches rather than curbing and pipes to convey stormwater. This pushed <br />the sidewalk further into the front yards due to the drainage ditches. This is not inherently a problem. <br />Page 580 of 637
