7. No more than 5 "for sale" vehicles per dealer may be displayed on the subject <br />property. <br />8. All motor vehicle repairs, bodywork, or detailing shall only occur inside the building. <br />9. Exterior doors shall be closed while any motor vehicle repair, body work, or detailing <br />occurs. <br />10. The dumpster area shall be screened with a six -foot -tall 100% opaque fence with the <br />gate closed when not in use. <br />11. The damaged vehicle storage area shall not exceed 900 square feet, must be screened <br />with a six -foot -tall 100% opaque fence, must be paved with an approved surface, and <br />shall meet all setbacks. <br />12. No outdoor storage of damaged or inoperable vehicles shall be allowed until the <br />required screening and paving are installed. <br />13. The storage of damaged or inoperable vehicles shall only be allowed inside of the <br />building or within the damaged vehicle fenced storage area. <br />14. Paints, chemicals, or other hazardous materials shall be handled and disposed of in <br />accordance with the Minnesota Pollution Control Agency (MPCA). <br />15. The applicant and/or property owner shall ensure any vehicle stored outside does <br />not leak fuels or other hazardous materials onto the ground or into the stormwater <br />pond to the west of the parking lot. <br />16. Parking stalls shall be striped in accordance with City Ordinance, Section 30-892 by <br />May 31, 2023. <br />Termination of Permit. The Permit shall remain in effect only for so long as the conditions set for the herein <br />are complied with. The City may revoke the Permit following a public hearing for violation of the terms and/or <br />conditions set forth in the Permit. <br />Lapse. If within two (2) years of the issuance of the Permit the proposed work described in a conditional use <br />permit has not been substantially completed, the permit shall expire and become void, except that the council <br />may, following recommendation of the planning commission, extend the permit for an additional period <br />determined by the council on the receipt of a request for a permit extension prior to its expiration. A conditional <br />use permit authorizes only the use specified in the permit and shall expire if, for any reason, the authorized use <br />ceases for more than six (6) months. <br />Criminal Penalty. Both the owner and any occupant of the Subject Property are responsible for compliance <br />with the perrrut. Violation of the terms of the Permit is a criminal misdemeanor. <br />Recording. The Permit shall be recorded against the title to Subject Property. <br />Page 172 of 184 <br />
